Immigration Division (ID)
When someone is detained or facing an admissibility hearing, hours matter.
What the ID does
The Immigration Division holds admissibility hearings for people the CBSA or IRCC believe should not be allowed to enter or stay in Canada, and it reviews the detention of people held by the CBSA. Detention is reviewed within 48 hours, again within 7 days, and then at least once every 30 days until the person is released or removed.
Acting fast on detention
In a detention review the member decides whether continued detention is justified or whether release on conditions is appropriate. A strong release plan, a bondsperson, and clear answers to the grounds for detention can change the result. Because the clock is short, we move immediately when a loved one is detained.
How we help
We prepare and present admissibility and detention cases, build release plans and terms and conditions, challenge the allegations where there is a basis to, and coordinate next steps if a removal order is issued, including any appeal to the IAD.
